Terms of Use

These Terms of Use ("Terms") govern your use of iOS applications published by Matthew Barge ("Developer", "we", "us", or "our"). By downloading, installing, or using any of our apps, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our apps, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use our apps.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use our apps for personal, non-commercial purposes in accordance with these Terms and Apple's App Store Terms of Service.

• You may not copy, modify, distribute, sell, or lease any part of our apps
• You may not reverse engineer or attempt to extract the source code of our apps
• You may not use the app for any illegal or unauthorized purpose

3. Subscriptions and Purchases

Some of our apps offer in-app purchases or subscriptions:

• Billing: Payment will be charged to your Apple ID account at confirmation of purchase
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Managing Subscriptions: You can manage subscriptions and turn off auto-renewal in your Account Settings after purchase
• Refunds: All purchases are processed by Apple. Refund requests must be submitted through Apple's App Store
• Price Changes: We reserve the right to modify subscription prices with advance notice

4. User Content

If you create, upload, or share content through our apps:

• You retain ownership of your content
• You grant us a license to use, process, and display your content solely to provide app functionality
• You are responsible for ensuring your content does not violate any laws or third-party rights
• We reserve the right to remove content that violates these Terms

5. Third-Party Services

Our apps may integrate with third-party services (e.g., AI APIs, analytics). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

6. Disclaimer of Warranties

Our apps are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the app will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any content or results

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the app
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful components transmitted through the app

8. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the app or violation of these Terms.

9. Changes to Terms

We may revise these Terms from time to time. The updated Terms will be posted with a new "Last Updated" date. Your continued use of the app after changes constitutes acceptance of the revised Terms.

10. Termination

We reserve the right to terminate or suspend your access to our apps at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the app shall be subject to the exclusive jurisdiction of the courts in the United States.

12. Apple-Specific Terms

In addition to these Terms, your use of our apps is subject to Apple's Licensed Application End User License Agreement (EULA). In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall control.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of our apps.
